IPTV BROADCAST LTD. Terms and Conditions – Please read carefully! Right of Withdrawal General: Users under these terms and conditions are individuals entering into a contractual relationship for non-commercial and non-professional activities. Entrepreneurs under these terms and conditions are individuals, legal entities, or legally recognized business partnerships entering into a contractual relationship in their corporate capacity or capacity as self-employed professionals. Customers under these terms and conditions are users as well as entrepreneurs. Right of Withdrawal under Distance Selling Contracts (BGB § 312d): The user (BGB § 13) is entitled to the right to withdraw under distance selling contracts. Legal right is granted to the user to withdraw from the contract within two weeks of the receipt of merchandise without providing reason for withdrawal. Withdrawal may be written; to withdraw written notification within the alloted time period to the following address is sufficient: IPTV BROADCAST LTD. - Suite F 1st Floor - New City Chambers, 36 Wood Street - Wakefield, West Yorkshire, WF1 2HB - Great Britain The customer bears postal costs for return when the correct merchandise was delivered and the price of the merchandise does not exceed 40.- Euros, or when the customer has not yet payed by a higher merchandise price at the time of withdrawal, or has failed to pay a due installment. Otherwise IPTV BROADCAST LTD. bears the cost of return. Reimbursement will be limited in amount to the most cost effective delivery method (Postal Service Standard Package Rate). In order to receive reimbursement the customer must fulfill the necessary obligations within 30 days following his/her sending of the declaration of withdrawal. Depreciation resulting from normal use is borne by the user unless the depreciation can be attributed to the merchandise itself upon inspection. Depreciation can be avoided when the merchandise is handled carefully and the installation of components is carried out solely by qualified and authorized technicians. The right of withdrawal is also revoked when services are supplied in the following cases: when another service is employed prior to the expiration of the right of withdrawal with the explicit consent of the consumer or when the consumer has induced a situation is which other services have been used, for example, by downloading software. The right of withdrawal does not exist for the following: software, software licenses, as well as for CDs or DVDs which have been opened by the consumer. The right of withdrawal is inapplicable when merchandise has been produced to a customer's specifications. § 01. General Terms: The following terms govern the contractual relationship between IPTV BROADCAST LTD.and its customers. They are valid for all services rendered by IPTV BROADCAST LTD. within the scope of services offered and contain a number of instructions for the use of software distributed by IPTV BROADCAST LTD.. § 02. Scope of Services: Services rendered by IPTV BROADCAST LTD. include the use of software from IPTV BROADCAST LTD. The customer receives a standard user license. Software, graphics, or other data may not be reproduced or redistributed without the express written permission of IPTV BROADCAST LTD.. With the installation of the software additional costs from third parties may potentially arise. If additional contracts are entered into during the course of access between the user and any third parties these contracts are entered into purely between the user and the relevant third party. § 03. Contract Subject Matter The customer receives a standard software license free of charge for the software. In return the customer agrees to cooperate with IPTV BROADCAST LTD. in terms of marketing and accepts the installation of IPTV BROADCAST LTD. advertising-supported software. The customer is made aware and accepts that with the installation of IPTV BROADCAST LTD. advertising-supported software a number of changes to the customer's computer system may be effected, including, but not limited to: - Commercial banners and pop-ups may appear. - Advertisements from IPTV BROADCAST LTD. or other third parties may appear. - Search terms inputted by the user may be analysed in order to customize the above. - The assigned home page of the internet browser may be changed. - URLs may be redirected. The software installs a browser expansion that is installed under c:/windows/system32 (under normal Windows installation). The customer declares his approval for the installation of the software when clicking the installation button. Using this software customer data will be collected and used to customize the advertising presentation for the customer. In order to maximize the advantages offered by the software the customer understands and approves of the use of system resources and bandwidth by the advertising-supported software. The customer is aware and recognizes that IPTV BROADCAST LTD. makes all possible efforts to protect the confidentiality and integrity of the customer's computer resources and communications. The foregoing nonwithstanding, IPTV BROADCAST LTD. makes no guarantees or warranties concerning the maintenance of the confidentiality and integrity of the customer's computer resources and communications. The customer is additionally aware and recognizes that IPTV BROADCAST LTD. cannot know nor control the content of communications disseminated by third parties through the advertising-supported software. This content is not maintained or controlled by IPTV BROADCAST LTD.. The individual or entities disseminating such content are solely responsible for its nature.The customer may be exposed to content deemed obscene, immoral, or otherwise objectionable. IPTV BROADCAST LTD. is not liable for the communications received by the customer while using the software. Customer data will not be transfered to IPTV BROADCAST LTD.. The transfer of IP addresses as well as allocation codes and URLs takes place solely to enable the presentation of advertisements for the customer and occurs only as a technically necessity. Further processing of customer IP addresses or customer data does not take place. IPTV BROADCAST LTD. does not transfer data to any third parties. Any data transfered to IPTV BROADCAST LTD. remains anonymous. Important Notice: The customer understands that updates for the software may from time to time become available. The customer authorizes IPTV BROADCAST LTD. to automatically transfer and install software updates onto the customer's computer. A new internet connection will not be made for this purpose. § 04. Contract Acceptance, Contract Duration, Cancellation The IPTV BROADCAST LTD. may refuse to enter into a contractual relationship with any customer without providing reason for the refusal. The contract becomes effective with the installation of the software. The contract expires automatically 24 months from the start date. Cancellation is for both parties at any time possible providing just cause. In case of premature cancellation the customer can receive cost-free deinstallation software from IPTV BROADCAST LTD.. § 05. Complaints and Objections: Complaints and objections arising from this contractual relationship are to be made directly and in writing to: IPTV BROADCAST LTD. For damages caused by interruptions, errors, falsely transfered data, delays, disturbances, and in particular damages caused by errors or disturbances related to the transfer of data as well as the use, implementation, operation, or repair of devices, IPTV BROADCAST LTD. is only liable in the event of intentional and gross negligence. This limitation of liability is effective in particular when related to offered speed and errors resulting thereby. IPTV BROADCAST LTD. services are primarily intended for the private customer. IPTV BROADCAST LTD. is explicitly not liable for damages or problems that result for services when used as intended. Compensatory claims, regardless of their nature, are limited in amount to the total revenue received by IPTV BROADCAST LTD. up to the time of the occurance of the damages. Consequential harm caused by defect are also barred to the extent legally permissable. § 07. Data Protection: Legal basis for the handling of customer data as well as its processing is provided by the “German Teleservice Data Protection Law“ (Teledienstdatenschutzgesetz - TDDSG) as well as the “German Federal Data Protection Law“ (Bundesdatenschutzgesetz – BDSG). The customer allows for personal data (as per § 5 TDDSG) to be processed as required as well as electronically stored. Transfer of data to third parties will not occur. § 08. Severability Clause: Should any part of this contract, including this provision, become invalid or stand to become invalid, or in the event this contract has failed to cover any eventuality, the validity of the remaining provisions of the contract are unaffected.
